Terms of Service

1. Acceptance of Terms

By accessing and using VelocityWanted ("the Platform"), operated by VelocityWanted Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all users of the Platform, including seekers (buyers), scouts (sellers/finders), and casual visitors.

2. Description of Service

VelocityWanted operates a reverse marketplace for classic and exotic vehicles. Seekers post "bounties" detailing specific vehicles they wish to purchase, including budget and conditions. Sellers or Scouts can browse these bounties and submit matching vehicle offers. We act strictly as an introductory platform and venue; we are not a broker, dealer, or party to any vehicle transaction.

3. User Obligations and Conduct

  • Accurate Information: You agree to provide true, accurate, current, and complete information when registering an account, posting a bounty, or submitting a vehicle offer.
  • Title and Authority: Sellers must possess the legal authority to sell the vehicle offered or have explicit authorization from the legal owner.
  • Prohibited Actions: You may not use the Platform for fraudulent purposes, post false or misleading listings, circumvent Platform fees, harass other users, or distribute malicious code.
  • Age Restriction: You must be at least 18 years old to use the Platform.

4. Platform Fees and Transactions

While posting a bounty or browsing is free, completed transactions facilitated through the Platform may be subject to a success fee (e.g., a 2.5% Introduction Fee) payable by the buyer, seller, or both, as explicitly outlined at the time of offer acceptance.

Circumvention: Attempting to circumvent the Platform to avoid fees after an introduction has been made through VelocityWanted is strictly prohibited and will result in permanent account termination and potential legal action for breach of contract.

5. Disclaimer of Warranties; Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VelocityWanted does not inspect, guarantee, or warrant the condition, title, history, or safety of any vehicle listed on the Platform. Buyers are solely responsible for conducting their own due diligence, including physical inspections, title checks, and verifying vehicle history before completing any transaction.

Under no circumstances shall VelocityWanted, its officers, directors, employees, or agents be liable to you or any third party for any direct, indirect, incidental, special, punitive, or consequential damages arising out of your use of the Platform or any transaction resulting from it.

6. User-Generated Content

By submitting photos, text, and other content ("User Content") to the Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with operating and promoting the Platform. You represent and warrant that you own or have the necessary rights to grant this license.

7. Account Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms, suspected fraud, or abusive behavior.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively through binding arbitration conducted in Delaware, except that you may assert claims in small claims court if they qualify.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of these Terms and/or posting a notice on the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
